A Superior Court Judge in Sacramento County has ruled in favor of raisin growers who challenged the legality of the California Raisin Marketing Board.

The Raisin Marketing Board was formed about 15 years ago under the state’s Marketing Act. The growers claimed the board did not meet the legal requirements when it was formed.

The judge agreed with the growers, stating there was no evidence that at the time the board was formed, there was the kind of severe adverse economic conditions the Marketing Act was intended to address. So far, the implications of the ruling are not determined.
